TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before confirming your registration and making payment. By completing your registration, you are agreeing to the terms and conditions laid out below.

Organiser & Eligibility
1. Through The Challenge (Event) is organised by Neupulse Sdn Bhd (BiiB) and is open to everyone in Malaysia only (Malaysian and non-Malaysian).
2. All minors (18 and below) must obtain consent from their parents/legal guardian to be bound by the Terms & Conditions set out herein to participate in this Event.
Participation
1. Registration will start from 1st March 2021(00:00) until 1st April 2021(23:59). No late registration will be accepted, unless otherwise arranged. BiiB’s decision is final and no further correspondence or appeal will be entertained.
2. The challenge/running period for this Event will start from 2nd April 2021(00:00) until 5th May 2021(23:59). There will be no extension of submission, unless otherwise arranged. BiiB’s decision is final and no further correspondence or appeal will be entertained.
3. All Participants are encouraged to use the MapMyRun app and only MapMyRun or BiiB app can be used in this event to track your activities.
4. All submission of results must be submitted within 24 hours of the activity and before 11.59PM. Any late submission will not be accepted.
  1. Challenge 1 – Time Trial - Before 23:59 of the day of the activity
  2. Challenge 2 – Training program - Each day based on the training program
  3. Challenge 3 – Final Test - Before 23:59 of the day of the activity
5. Participants are required to complete the challenge within ONE activity for the Time Trial and Final Test Challenge.
6. Participants are allowed to complete the Training Program challenge in one or an accumulation of multiple runs.
7. Participants are responsible to ensure that their results are well tracked and synced to BiiB platform.
8. Participant’s submission must have the required information:
  1. Distance
  2. Duration
  3. Pace
  4. Date & Time
9. Participants are not allowed to make amendments on their results once it has been submitted. Participants are required to delete the wrong submission and resubmit their results again within 72 hours.
10. Participants will be automatically disqualified if one of the following is identified/occurs:
  1. Unrealistic/faulty results (evidence & data will be collected).
  2. Sharing/Tag along activities are found.
  3. Failure to respond to the result enforcement officer within 24 hours.
11. BiiB has the right to disqualify and reject any submission that is suspicious and/or incomplete and the decision is final, and no further correspondence or appeal will be entertained.
Selection Criteria
1. Participants will be selected into the TOP 100 Runners for training based on the following criteria:
  1. Terms and conditions set out for each of the specific challenges.
  2. Completion of the minimum requirement set for each challenge by the end of the challenge period.
  3. If more than 100 participants are eligible for the Top 100 training, BiiB and RFA reserves the right to select the participants based on their challenges completion rate and progress.
  4. Top 20 runners will be selected and awarded with Under Armour running gears based on the fulfilment of the criteria set in the challenges.
  5. 10 female and 10 male runners will be selected by BiiB and RFA as the Top 20 runners.
2. BiiB’s decision is final and no further correspondence or appeal will be entertained.
Rewards
1. Rewards are given out on an ”As Is” basis and are non-transferable, non-refundable, non-exchangeable for cash or with vouchers of other denominations, whether in part or in full.
2. Any Reward not won or unclaimed will be forfeited, it will thereafter be deemed to have lapsed unconditionally and irrevocably. The selected runners whose Reward has been forfeited or unclaimed is not entitled to any payment or compensation from BiiB or its partners notwithstanding non-receipt of notification.
Delivery of Reward(s)
1. BiiB reserves the right to appoint a third party (3rd) party vendor or service provider to handle the fulfilment or making available of the Reward and delivery of the Reward(s) to you. By providing your personal information including name, delivery address, contact numbers, email address and other information to BiiB, BiiB can use and/or disclose to such third party (3rd) party vendor or service provider for the purposes of delivery service.
2. BiiB shall not be liable for any missing courier due to incomplete/wrong/inadequate information provided by the Participants or wrongdoing/damages or lost from the courier company.
3. BiiB shall not be responsible or liable for any delays or non-delivery of the Reward.
4. Shipping of Reward(s) will begin before the end of the event.
5. Re-delivery of returned rewards is subject to additional shipping charges.
6. Re-delivery of returned rewards will only be processed within ONE (1) month of the returned date. Any rewards not processed/claimed within the one month will be considered as unclaimed.
7. No more than one attempt shall be made to re-deliver the item. If re-delivery exceeds two attempts, the item will not be returned via post and will need to be collected in person.
Terms of Participation
1. BiiB reserves the right to check the validity of each submission. Submissions failing to comply with the Terms and Conditions herein will not be accepted.
2. BiiB reserves the right to disqualify any Participant suspected of fraud, or if BiiB believes that the Participant’s submission and/or result has been manipulated in any way by machines or computers.
Liability & Responsibility
1. BiiB declares by virtue of being the Organiser, they may engage services of third parties at any point of time as deemed fit.
2. BiiB reserves the right to modify or substitute any of these rules and regulations of the Event from time to time as they deem fit. If there is ambiguity in any of the provisions, BiiB shall be the authority to interpret and in so doing, BiiB will take into account the interests of all affected Participants.
3. The completion and the submission of the online registration form confirm the Participant's agreement to abide by the relevant rules and regulations of BiiB. The Event’s registration will be confirmed via the Welcome Email which will be sent to the email address registered with BiiB. The Participant shall inform BiiB via Official Email at [email protected] if the Participant does not receive the Welcome Email or any information entered during registration is inaccurate.
4. Participant agrees to provide true, accurate, current, and complete information about the Participant. BiiB may contact the Participant from time to time via email. Any notice sent to the email address registered with the Organiser shall be deemed as received by the Participant. If the Participant provides any information that is untrue, inaccurate, not current, or incomplete, or BiiB has grounds to suspect that such information is untrue, inaccurate, not current or incomplete, BiiB may suspend or terminate the Participant's registration.
5. There will be NO REFUND to Participants who do not eventually take part in the Event for whatever reason it may be.
6. BiiB will not entertain nor be in any way responsible for any disputes arising from incomplete or inaccurate entry details in the registration form.
7. BiiB reserves the right to change the Date, or to cancel the Event at any time without prior notice to the Participant, in which case BiiB will make an effort to inform the Participant prior to the Date. If the Event must be cancelled, there shall be NO refund of fees and BiiB and its partners shall not be liable for any other loss or inconvenience caused. Any updates on the Event including any changes will be informed. It is the responsibility of the Participants to keep abreast with such updates and changes. BiiB shall not be liable for any loss or inconveniences caused.
8. There will be no refund of registration fees, if the Event is cancelled for reason of force majeure i.e. due to occurrence of incidents that are beyond the control of BiiB (including but not limited to haze, storm, rain, inclement weather, wind, act of God, terrorism, pandemic, government’s declaration of an enhanced movement control order and/or emergency or other conditions) and which in BiiB’s opinion, renders it impossible or unsafe to hold the Event.
9. BiiB reserves the right to limit and/or refuse entry without giving any reason and notice whatsoever.
10. BiiB reserves the right to cancel and/or add any Event category without giving any reasons whatsoever as well as provide prior notice to the Participant.
11. This Event is a virtual event, Participants may walk/run at their own convenience during the Event Challenge Period, anytime and anywhere. Participants shall run at their own risk and BiiB and its partners will not be responsible or held liable for any injury or death, damage, or loss of property, whether personal or otherwise, suffered or caused, arising from training for, during participation, or after participation in the Event. Participants are strongly advised to go for a medical examination and/or consult their medical practitioner prior to registration and before the Event.
12. BiiB reserves the right to use and share to its partners any information shared during submission - photographs (including those of Participants), motion pictures, recordings, or any other media records of the Event, for any legitimate purpose including commercial advertising and distribution.
Entitlements
1. All Participants will be awarded an e-certificate and a medal. The E-Certificate will be emailed to the email and address registered after the end of the event.
Privacy Policy
1. By participating in this Challenge, the Participants agree and acknowledge that BiiB collects, uses, and processes and/or discloses (including third party overseas) participants’ personal information in order to conduct this Event. Each participant consents to such collection, use, processing, and disclosure of his/her personal information and represents and warrants that all information provided is true and accurate in all respects. Validity of registration is conditional on providing this information. Each Participant agrees that BiiB may, for a reasonable period of time, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or making phone calls to the Participant(s).
2. Under Armour reserve the rights to promote any of its products/promotions directly or indirectly to all participants.
Jurisdiction
1. The Terms and Conditions shall be governed and construed in accordance with the laws of Malaysia, and each contestant irrevocable submits to the non-exclusive jurisdiction of the courts of Malaysia.
